Welcome to Segmental, a product by 70/30 Digital Oy ("we," "our," or "us"). These Terms of Service ("Terms") explain your rights and responsibilities when you use Segmental. By using our service, you agree to these Terms. If you don't agree, please don't use Segmental.

1. Who We Are
Segmental is a marketing technology service that helps businesses manage and use first-party data. It is owned and operated by 70/30 Digital Oy, a company registered in Finland.

2. Eligibility
You must be at least 18 years old.

You must have the authority to agree to these Terms on behalf of yourself or your organization.

You agree to use Segmental only in compliance with applicable laws and regulations.

3. Your Account
You are responsible for all activity under your account.

Keep your login details secure.

Let us know immediately if you suspect unauthorized use of your account.

4. Your Content and Data
You retain ownership of the data, content, and materials you upload to Segmental.

You give us a limited license to process and store your data as needed to operate and improve Segmental.

You are responsible for ensuring you have the legal right to use and share any personal data you upload.

We handle personal data according to our Privacy Policy.

5. Our Content and Intellectual Property
All content, features, and technology in Segmental are owned by 70/30 Digital Oy or our licensors.

You may not copy, modify, distribute, sell, or lease any part of Segmental without our written permission.

6. Payments and Subscriptions
Some features require payment.

Fees are billed in advance and are non-refundable unless required by law.

We may change pricing with reasonable notice.

7. Acceptable Use
You agree not to:
Use Segmental for unlawful, harmful, or fraudulent purposes.

Attempt to disrupt or bypass Segmental's security.

Upload malicious code or infringe the rights of others.

8. Service Availability and Changes
We may update, change, or discontinue Segmental at any time.

We continuously develop Segmental. This means we may introduce new features, improve existing ones, or remove outdated features if they no longer serve their purpose or are replaced by better alternatives.

Some updates may be deployed automatically without prior notice.

We strive for high availability but cannot guarantee the service will be uninterrupted or error-free.

9. Disclaimer and Limitation of Liability
Segmental is provided "as is" without warranties of any kind.

We are not liable for any indirect, incidental, or consequential damages arising from your use of Segmental.

Our total liability to you is limited to the amount you paid us in the 12 months before the claim.

10. Termination
You can stop using Segmental at any time.

We may suspend or terminate your access if you violate these Terms.

Certain sections (including those on liability, intellectual property, and data rights) will survive termination.

11. Governing Law and Disputes
These Terms are governed by the laws of Finland, excluding conflict of laws rules.

Any disputes will be resolved in the courts of Helsinki, Finland.

12. Changes to These Terms
We may update these Terms from time to time.

If we make significant changes, we will give reasonable notice before they take effect.

This Privacy Policy explains how Segmental, a product by 70/30 Digital Oy ("we," "our," or "us"), handles personal data when you use our service.
We respect your privacy and comply with the General Data Protection Regulation (GDPR) and other applicable laws.

2. Your Data and Ownership
All data you provide to Segmental is owned by you (the "Client").

We process your data only as instructed by you to provide the Segmental service.

We do not sell, share, or use your data for our own marketing purposes.

3. Our Role Under GDPR
You are the Data Controller — you decide what data is collected and how it is used.

We are the Data Processor — we process your data only to deliver Segmental's functionality.

Our processing activities are governed by these Terms and, where applicable, a separate Data Processing Agreement (DPA).

4. How We Use the Data
We process data to:
Provide, operate, and improve Segmental.

Enable the creation of marketing segments, campaigns, and reports.

Provide customer support.

Ensure security, prevent fraud, and maintain service integrity.

We do not use your personal data for profiling or automated decision-making unrelated to your instructions.

5. Data Storage and Security
Your data is stored securely using encryption and industry-standard safeguards.

Access to personal data is restricted to authorized personnel who need it to provide the service.

We take reasonable steps to protect against unauthorized access, loss, misuse, or alteration.

6. Data Sharing and Subprocessors
We may use trusted third-party service providers ("Subprocessors") to host and process your data.

All Subprocessors are bound by GDPR-compliant agreements.

We will provide a list of current Subprocessors upon request.

7. Data Location
Your data may be stored and processed within the European Economic Area (EEA).

If processing occurs outside the EEA, we ensure it is protected by adequate safeguards such as EU Standard Contractual Clauses.

8. Data Retention
We keep your data for as long as your account is active or as needed to provide the service.

After account closure, we will delete or anonymize personal data within a reasonable period, unless required by law to keep it longer.

9. Your Rights Under GDPR
You have the right to:
Access your personal data.

Correct inaccurate data.

Request deletion of your data.

Restrict or object to processing.

Request data portability.

Withdraw consent (where processing is based on consent).

Data Processing Agreement (DPA)
This Data Processing Agreement ("Agreement") forms part of the Terms of Service between:
Client (the "Data Controller") — the entity who owns and controls the data; and

70/30 Digital Oy (the "Data Processor") — the operator of the Segmental platform.

This Agreement sets out the terms under which the Data Processor processes personal data on behalf of the Data Controller.

1. Definitions
Personal Data: Any information relating to an identified or identifiable natural person processed by the Data Processor on behalf of the Data Controller.

Processing: Any operation performed on personal data, including collection, storage, use, disclosure, or deletion.

Data Controller: The party that determines the purposes and means of the processing of personal data.

Data Processor: The party that processes personal data on behalf of the Data Controller.

2. Subject Matter and Duration
The Data Processor will process personal data only to provide the Segmental service as described in the Terms of Service.

This Agreement is valid for the duration of the contractual relationship between the parties.

3. Nature and Purpose of Processing
The Data Processor processes personal data solely to perform services requested by the Data Controller, such as segment creation, marketing automation, and reporting.

4. Types of Personal Data and Data Subjects
Types of personal data typically include pseudonymised identifiers (e.g. customer_id) and contextual attributes (e.g. segment information, location attributes). Direct personal identifiers (e.g. names, email addresses) are not required nor typically processed.

5. Obligations of the Data Processor
Process data only on documented instructions from the Data Controller.

Implement appropriate technical and organizational measures to protect personal data.

Assist the Data Controller in fulfilling its GDPR obligations (e.g., data subject rights, breach notifications).

Ensure personnel authorized to process data are committed to confidentiality.

Notify the Data Controller without undue delay of any personal data breach.

Delete or return all personal data upon termination of the agreement unless legally required to retain it.

6. Subprocessors
The Data Processor may engage subprocessors to assist with processing.

The Data Processor will inform the Data Controller of any intended changes regarding subprocessors and provide an opportunity to object.

Subprocessors are bound by data protection obligations consistent with this Agreement.

7. Data Transfers
Personal data may be transferred outside the EEA only with appropriate safeguards such as EU Standard Contractual Clauses.

The Data Processor will notify the Data Controller of such transfers.

8. Data Subject Rights
The Data Processor will assist the Data Controller in responding to data subject requests related to access, rectification, erasure, restriction, and portability.

9. Audit and Inspection
The Data Processor will make available all information necessary to demonstrate compliance and allow audits by the Data Controller or an appointed auditor.

10. Liability
Each party is liable for its own compliance with applicable data protection laws.

11. Governing Law and Jurisdiction
This Agreement is governed by Finnish law.

Disputes will be resolved in the courts of Finland.

Segmental is a service provided by 70/30 Digital Oy and/or its affiliates ("Segmental", "we", sometimes "us"). Segmental provides website features and other products and services to you when you visit urgentcaller.app website, use Segmental products or services, use Segmental applications for mobile, or use software provided by Segmental in connection with any of the foregoing (collectively, "Segmental Services"). Segmental provides the Segmental Services subject to the following conditions.

By using Segmental Services, you (Client) agree to these conditions. Please read them carefully. We offer a wide range of Segmental Services, and sometimes additional terms may apply. When you use an Segmental Service you also will be subject to the guidelines, terms and agreements applicable to that Segmental Service ("Service Terms"). If these Conditions of Use are inconsistent with the Service Terms, those Service Terms will control.

PRIVACY

Please review our Privacy Policy, which also governs your use of Segmental Services, to understand our practices.

ELECTRONIC COMMUNICATIONS

When you use any Segmental Service, or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site or through the other Segmental Services. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

COPYRIGHT

All content included in or made available through any Segmental Service, such as text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations is the property of Segmental or its content suppliers and protected by Finland's and international copyright laws. The compilation of all content included in or made available through any Segmental Service is the exclusive property of Segmental and protected by Finland's and international copyright laws.

LICENSE AND ACCESS

Subject to your compliance with these Conditions of Use, Segmental or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal use of the Segmental Services. This license does not include any resale or commercial use of any Segmental Service, or its contents; any collection and use of any product listings or descriptions; any derivative use of any Segmental Service or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Conditions of Use or any Service Terms are reserved and retained by Segmental or its licensors, suppliers, publishers, rightholders, or other content providers. No Segmental Service, nor any part of any Segmental Service, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Segmental. No part of Segmental Service may be decompiled, reverse-engineered, disassembled or otherwise reduced to source code or other human-perceivable form, to the full extent allowed by law. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Segmental without express written consent. You may not use any meta tags or any other "hidden text" utilizing Segmental's name or trademarks without the express written consent of Segmental. You may not misuse the Segmental Services. You may use the Segmental Services only as permitted by law. The licenses granted by Segmental terminate if you do not comply with these Conditions of Use or any Service Terms.

YOUR ACCOUNT

If you use any Segmental Service, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Segmental reserves the right to refuse service, terminate accounts, remove or edit content in its sole discretion.

SERVICE DESCRIPTIONS

Segmental attempts to be as accurate as possible. However, Segmental does not warrant that product descriptions or other content of any Segmental Service is accurate, complete, reliable, current, or error-free. If a service offered by Segmental itself is not as described, your sole remedy is to communicate the problem via contact form on the Segmental mobile application.

CUSTOMER PRODUCED CONTENT

Segmental is not responsible for any Client produced content. All content produced by Client is owned by the Client and the Client is responsible to comply with any legal requirements affiliated to the content and it's use. Client also agrees to conform with any additional guidelines and instructions given in addition to those in these terms.

LIABILITY OF CHANGES IN ASSOCIATED SERVICES

Segmental functions in close interaction with third party service providers, online and offline, such as Google, Facebook and many others. Segmental assumes no liability in cases of sudden third third third party service changes or restrictions of these third Segmental Services, which may or may not affect Segmental Services functionality directly or indirectly.

LEGAL LIABILITY

The Client agrees to comply with any legal requirements associated to the use of Segmental Services in its country of origin, and in the current country of Client's residence, while using Segmental Services, when legally obliged. The Client explicitly acknowledges that it has full liability over all actions executed by using Segmental Services. By using Segmental Services the Client agrees to all the terms and conditions in this document. If any of the terms or conditions in this document conflict with the terms and conditions written in this paragraph, the terms and conditions written in the "LEGAL LIABILITY" will remain effective and invalidate the conflicting terms or conditions.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY THE Segmental SERVICES AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE Segmental SERVICES ARE PROVIDED BY Segmental ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. Segmental MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE Segmental SERVICES, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE Segmental SERVICES, UNLESS OTHERWISE SPECIFIED IN WRITING. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

DISPUTES

Any dispute or claim relating in any way to your use of any Segmental Service, or to any products or services sold or distributed by Segmental or through Segmental.com will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

APPLICABLE LAW

By using any Segmental Service, you agree that the Finnish law, will govern these Conditions of Use and any dispute of any sort that might arise between you and Segmental.

3. NAME OF REGISTER

Segmental customer register.

4. PURPOSE OF PROCESSING THE PERSONAL DATA

The primary reason for processing of personal data is the customer relationship between Segmental and its customer, the customer's consent details, the customer's commission, or another relevant association. Personal data can be processed for the following purposes:

Managing, implementing, developing, and monitoring a customer relationship, customer service, and related communications and marketing.­ Analysing and grouping customer relationships and reporting on them, along with other purposes related to the development of Segmental's business operations and the customer relationships in general.­ Allocation of communications, marketing, and services, and management of campaign, contact, and transaction history.­ Collation and processing of customer feedback and customer-satisfaction information. Implementation of marketing research and opinion surveys.­ Other purposes in accordance with the terms of use of the Segmental.com or another service.­ The processing of personal data may be outsourced to Group companies and/or external service providers.

5. REGISTER'S DATA CONTENT

Information stored on the data subject may include, for example, the following: Name, nickname, customer number, sex, language, location information based on coordinates, telephone number, e-mail address, and other necessary contact information. Also other personal data such as topics of interest, person's behavioural data may be stored. Other stored data includes information on the use of services and information on the implementation of marketing and communications in the various transaction channels, such as the online and automated services. The content produced by the data subject him- or herself, such as customer feedback, and additional information entered – e.g., wishes related to the customer relationship, satisfaction information, areas of interest and similar information. The information that the Segmental user has stored on him- or herself and on any other persons linked to the customer's profile. Services wanted and used by the data subject. Prohibitions, limitations, consent, and other choices. Other information related to the purpose of the register. Information necessary for the use of authentication and verification tools and services. Information on the processing of data, such as the storage date and the information source. Some of the data is provided by the user optionally, while some data is mandatory to use the service.

6. REGULAR SOURCES OF INFORMATION

Information is received mainly from the following sources:

From the data subject him- or herself, from the use of services related to the data subject’s customer relationship or other relevant connection, communications, and events related to transactions and other activities. Parties offering services related to authentication, verification, updates, or similar services. Segmental-internal and other reliable sources.

7. REGULAR DISCLOSURE OR TRANSFER OF PERSONAL DATA OUTSIDE THE EUROPEAN UNION OR THE EUROPEAN ECONOMIC AREA

Customer data will not be disclosed to parties other than those participating in the production, development, or maintenance of services or communications of Segmental or on its behalf, except when based on an agreement, other consent, and regulations. Customer data primarily will not be transferred outside the European Union or the European Economic Area.

8. DESCRIPTION OF THE PRINCIPLES IN ACCORDANCE WITH WHICH THE DATA FILE HAS BEEN PROTECTED

Any physical material is stored in a locked space where only people with separate rights have access. Digital material can only be accessed by employees specifically entitled to do so or private practitioners with a personal user ID and password. There are different levels of access rights, and each user is issued sufficient rights, though as limited as possible, for taking care of his or her work tasks.

9. RIGHT TO INSPECT

The data subject has the right to inspect Segmental's customer register with respect to the stored data concerning him or her. The inspection request must be made in writing or by another authenticated method and addressed to the controller, who decides on the inspection right. The data subject's identity is confirmed from an identity card with a photo before supplying of the information. The right to inspection may be declined on statutory grounds.

10. CORRECTION OF DATA

The user of the Segmental Services can update his or her basic personal data via the online Segmental mobile application. Insofar as the data subject or user can act him- or herself, after having been informed of an error in the data or having detected such an error him- or herself, he or she must, without undue delay, on his or her own initiative, rectify, delete, or complement the inaccurate, unnecessary, incomplete, or outdated personal data or the data contrary to the purpose of Segmental or another service. Insofar as the data subject cannot rectify the data him- or herself, the rectification request is made by means of a signed document or via another authenticated method and addressed to the controller, who decides on the rectification. If necessary, the identity of the data subject is verified from an identity card with a photo before correction or deletion of the information.

11. RIGHT TO REFUSE

The customer can give 70/30 Digital Oy direct-marketing consent in line with the Act on the Protection of Privacy in Electronic Communications, Section 26, or prohibit 70/30 Digital Oy from processing his or her personal data for direct-marketing purposes in accordance with the Personal Data Act's Section 30. The customer can consent to direct marketing channel-specifically (e.g., by mobile by mobile phone or e-mail). The customer has the option of prohibiting direct marketing via the various channels (phone, post, and e-mail), marketing surveys, and the utilisation of his or her data for marketing purposes. This right to refuse does not extend to customer communications, advertising, or benefit communications related to the content of services or the customer relationship. If the customer does not give any consent and issues all possible prohibitions, he or she will be sent only the necessary notifications of the implementation of services and management of the customer relationship.
